Abstract

The present paper discusses two issues faced in Islamic financial transactions, namely, delayed payment of future asset usufruct lease and the trading of financial securities, made up of a mixture of assets, usufruct, cash and debts. Given their importance from a Sharia and an economic perspective, the two issues are dealt with in their details and ramifications in the present paper in detail in the light of analysis of the relevant resolutions of the International Islamic Fiqh Academy and some jurisprudence opinions contained in research presented in support of the said resolutions. After presentation and discussion of the matter with supporting analysis, documentation and deduction, the paper concludes that delaying payment or paying by installments in a future asset lease in a future usufruct lease is prohibited by the majority of scholars as it amounts to the sale of a debt by another debts. Further, there is no evidence permitting the trading of financial securities, made up of a mixture of assets, usufruct, cash and debts if the latter two were predominant. تناقش هذه الورقة العلمية إشكالين من الإشكالات التي تواجهها المعاملات المالية الإسلامية، هما: تأجيل الأجرة في إجارة منافع الأعيان الموصوفة في الذمة، وتداول الأوراق المالية التي تمثل موجوداتها خلطة من الأعيان والمنافع والنقود والديون. وهذان الإشكالان يعدان من أهم وأعقد الإشكالات في المالية الإسلامية من الناحيتين الشرعية والاقتصادية، لذلك سلطت هذه الورقة الضوء على تفاريعهما وتفصيلاتهما من خلال قراءةٍ لبعض قرارات مجمع الفقه الإسلامي الدولي الواردة بهذا الخصوص، وبعض الآراء الفقهية التي تضمنتها بعض البحوث التي قُدمت للمجمع توطئة لإصدار قراراته موضوع القراءة. وبعد العرض والمناقشة المشفوعين بالتحليل والتوثيق والاستدلال؛ انتهت الورقة إلى أن مسألة تأجيل الثمن أو تقسيطه في إجارة المنافع الموصوفة في الذمة ممنوعة عند جمهور العلماء لأنها من ابتداء الدَّين بالدَّين، وأنه لا دليل على جواز تداول الأوراق المالية التي تمثل موجوداتها خليطًا من الأعيان والمنافع والنقود والديون؛ إذا كانت الغلبة لهذين الأخيرين.
