Abstract

The aim of this research is to develop a formula for the reconstruction of the waqf in a contemporary form, namely the contract of construction, operation and repatriation, and how to benefit from this contract in the development of waqf construction. This can only be achieved by clarifying the reality of the BOT contract, its jurisprudential description, its Shariah judgment, and the jurisprudential provisions of the BOT contract in the financing of endowments, as well as the applications of the BOT contract in the field of endowments, and developing it in accordance with its purposes, purposes and endowments. One of the main research paths charted by the Sheikh Rashid Bin Dayel Chair for Endowment Studies at Imam Muhammad bin Saud Islamic University was the development of endowment products. The researcher concluded his research with a number of recommendations. Developing the methods, standards and mechanisms of endowment control. هدف هذا البحث هو تطوير صيغة لإعمار الوقف بصيغة معاصرة، وهي عقد البناء والتشغيل والإعادة، وكيفية الاستفادة من هذا العقد في تطوير بناء الوقف. ولا يتحقق ذلك إلا ببيان حقيقة عقد البناء والتشغيل والإعادة، وتوصيفه الفقهي، وحكمه الشرعي وبيان الأحكام الفقهية لعقد البناء والتشغيل والإعادة في تمويل الأوقاف كما بين البحث تطبيقات عقد البناء والتشغيل والإعادة في مجال الأوقاف، وتطويره بما يتلاءم مع مقاصده، ومقاصد الوقف وأحكامه. لقد كان من المسارات البحثية الرئيسة التي رسمها كرسي الشيخ راشد بن دايل لدراسات الأوقاف بجامعة الإمام محمد بن سعود الإسلامية مسار تطوير المنتجات الوقفية، وهذا البحث يأتي داعماً لهذا المسار، والذي يعرض صيغة من صيغ تمويل بناء الأوقاف، وفق الأساليب المعاصرة للتمويل. اختتم الباحث بحثه بعدد من التوصيات ومن أهمها : حاجة لإصدار تنظيمات وتشريعات لهذا النوع من الاستثمار والتمويل في مجال الأوقاف، وتتضمن هذه التنظيمات كل ما من شأنه حماية الأوقاف، والمحافظة عليها. وتطوير أساليب الرقابة على الأوقاف، ومعاييرها، وآلياتها.
