Abstract

The main aim of this article and conversation is to elucidate the views of Shah Waliullah of Dehli on the objectives of Sharia (Maqasid), by tracing his writings at different points from his most distinguished book 'Hujjatullah al Baligha'(The Conclusive Argument from Allah). It should be noted that he uses three terms ' Masalih', 'Maqasid' and 'Asrar' in the context of this topic. It is obvious that he did not follow the methodology of any previous author of Maqasid, but rather, he derived the issues himself by conducting an in-depth analysis of the Quran and Sunnah. He is truly an outstanding personality in the deferent aspects of Maqasid. For instance, this phenomenon is perceivable in his explanation of the terminology "Irtifaqat". Apart from the translating this word in the dictionary , he furnished it as a new term which means : convenient customs and systems related to human life in fulfilling all needs. In addition, it is observed that certain important objectives have been explored very creatively in this book, such as Equilibrium in Sharia rules, brotherhood and cooperation, prevention of extremism, and purification of the soul and, moral values, , which deeply impact humanity. on my opinion, this luminous work is more pragmatic rather than theoretical, because the author focuses on the applications of Maqasid in a variety of chapters regarding Sharia. يهدف هذا الحوار إلى استجلاء فكر الإمام أحمد بن عبدالرحيم المعروف بـ شاه ولي الدهلوي (المتوفى سنة 1176هـ) حول مقاصد الشريعة، وذلك من خلال تتبع نصوص كلامه في كتابه المتميز "حجة الله البالغة". وقد ذكر المؤلف في موضع اسم الكتاب بإضافة "في علم أسرار الحديث". ومن الجدير بالذكر أنه تناول هذا الموضوع في مختلف المناسبات بكلمة " مقاصد" أو "مصالح" أو" أسرار". وقد استبان من خلال رصد تعابيره الدالة على المقاصد أنه توفر على هذا الموضوع في ضوء اطلاعه العميق على نصوص الكتاب والسنة. ولم يكن في هذا المجال تابعا لمنهج سلفه من الكاتبين في المقاصد. ففي الواقع نراه مبدعا مبرزا في تناوله جوانب متعددة في حقل المقاصد، فعلى سبيل المثال نلمس هذه الظاهرة فيما حرره وقرره في بيان "الارتفاقات"- وهي وثيقة الصلة بالمقاصد-، فبغض النظر عن معناها في أصل اللغة، صاغ لها مفهوما جديدا، ويعني بذلك كل ما سوى العبادات من الأنظمة والتسهيلات المرتبطة بكافة الشؤون من المعاملات والعادات التي لا تنفك عنها الحياة البشرية. إضافة إلى ذلك قد تصدى لبحث مقاصد مهمة أخرى في ثنايا الكتاب، منها: الوسطية، سد باب الغلو، الأخوة والتعاون، وقطع النزاع. وهي ذات بال من حيث أثرها العميق في حياة الناس.
