Abstract

Alleviation of difficulty and promoting ease in commandments is one of the defining characteristics of the Islamic Shar??ah. The scholars have derived a number of rules and legal maxims which explain and clarify this characteristic. One of the most important of these is the legal maxim “necessities make forbidden things canonically harmless”. Although this maxim is one of the most important maxims of Islamic law, it has been widely misused (and increasingly so) in determining the Islamic position in contemporary matters. Hence, this paper endeavors to highlight the importance of this maxim, clarify its exact meaning and establish its scope and the rules and regulations governing its application. The paper also studies some important issues related to the maxim. It then briefly discusses some other important maxims that are closely related to this maxim. Finally, the paper analyzes some contemporary financial issues in which scholars have used this maxim and critically evaluates its application in those matters based on the rules and regulation established in this paper. إن شريعتنا الغراء جاءت بالتيسير ورفع الحرج عن المكلفين وإن العلماء استنبطوا عددا من القواعد والضوابط تبين وتوضح هذا المعنى. وإن من أهم تلكم القواعد قاعدة "الضرورات تبيح المحظورات". ولما كثر الغلط في استعمال هذه القاعدة في وقتنا الحاضر رأيت أن أجعل موضوع بحثي دراسة هذه القاعدة، أستكشف من خلاله مدلولها وضوابطها وكيفية تطبيقها. فبادئ ذي بدء توضح هذه الورقة أهمية هذه القاعدة وتحدد مدلولها وضوابطها وتحرر بعض المسائل المتعلقة بها. وتعرج أيضا باختصار على بعض القواعد المهمة التي لها ارتباط وثيق بهذه القاعدة. وفي الأخير تستعرض الورقة بعض المسائل المالية المعاصرة التي استُخدِم فيها هذه القاعدة وتبين مدى صحة استخدامها من عدمها استنادا إلى القواعد والضوابط المحررة في الورقة.
