Abstract

Following Dr. Allehiane’s presentation of my thesis: "Exchange of Debt for Debt within the Maliki School of Jurisprudence and its Current Applications" I made a two-pronged statement: First, I explained some important Fiqh issues in the paper; second, I commented on Dr. Allehiane’s presentation as well as comments by the audience. The paper summed up the major points under four issues: (A) terminology in connection with “Exchange of “Debt for Debt” and its sub-divisions within the Maliki School, (B) methodology of definitions within the School, (C) methodological ambiguity adopted by a good number of the persons who conducted a comparative study between the three pronged approach of the Maliki School and the approach of other scholars, (D) the fragmented approach adopted by most of the scholars who studied matters pertaining to the issue. They failed to focus on the fundamentals and rules that govern the issues of “Debt for Debt”. These flaws have had adverse effects on the conclusions of the research papers. The salient points of my comments are as follows: 1. I explained that the claim that the statement I made in theory in the section entitled: Initiating “debt for debt” is at variance with what I said about allowing some future contracts.2. Such a claim is unfounded because I merely stated the position of Fiqh scholars and opted for permissibility owing to the fact that I consider the matter a necessity. I then reacted to someone who referred to Alzarqani by claiming that – in fact, he replicates what many modern scholars have stated – Alzarqani’s statement is explicit when it comes to the permissibility of initiating “debt for debt”. I pointed out that such a claim is premised on a tentative quest for anything that can support the permissibility of contemporary contracts, which are based on debt from both parties to a contract. As a result, they sacrifice meticulously comparative textual criticism. I explained with evidence that no one among Maliki scholars or other scholars has ever allowed “debt for debt”. As for the statement that “debt for debt” is devoid of any cause for dispute but the contrary is outlandish. In fact, I commented on this matter based on statements and demonstrations by scholars of all schools of jurisprudence. بعد عرض د. سعد اللحياني لرسالتي "مقابلة الدَّين بالدَّين في الفقه المالكي وتطبيقاته المعاصرة " كان تدخلي مرتكزا على شقين: أولهما بيان لبعض المسائل المهمة في البحث. وثانيهما تعقيبات على بعض ما طرح صاحب العرض والحضور الكرام. فأجملت المسائل المهمة في إشكاليات أربع هي: إشكالية المصطلح في موضوع مقابلة الدَّين بالدَّين وأقسامها عند المالكية، ثم إشكالية منهجية التعريفات عندهم، ثم إشكالية الخلط المنهجي عند كثير ممن درس هذا الموضوع بين منهج المالكية وتقسيمهم الثلاثي وبين منهج غيرهم، ثم إشكالية: النظرة التجزيئية التي سلكها أغلب الذين درسوا مسائل هذا الموضوع؛ حيث لم يرتكزوا على الأصول والقواعد والضوابط الحاكمة لمسائل الكالئ بالكالئ. ولهذه الإشكالات آثار وتداعيات سلبية ظهرت في نتائج البحوث التي لم تستحضرها. وأما التعقيبات فأهم ما فيها: بياني أن ما قيل من تناقض بين ما قررته نظريا في قسم ابتداء الدَّين بالدَّين وبين إباحتي لبعض عقود المستقبليات؛ ليس صحيحا لأنني قررت الحكم كما هو عند الفقهاء ثم رجحت الجواز بناء على الحاجة المنزلة منزلة الضرورة. ثم عقبت على استشهاد أحد المعقبين بنص للعلامة الزرقاني ادعى – وهو في ذلك تبع للعديد من المعاصرين- أنه صريح في إباحة ابتداء الدَّين بالدَّين؛ فبينت أن هذا الادعاء مبني على محاولة البحث عما يسند إباحتهم للعقود المعاصرة المبنية على الدَّين من طرفي العقد مما جعلهم يخلُّون بمنهج دراسة النصوص تدقيقا و جمعا ومقارنة ...إلخ. ووضحت بالدليل أنه لا أحد من المالكية ولا غيرهم أباح مقابلة الابتداء. وأما حديثه عن أن مقابلة الابتداء ليس فيها علة النزاع بل هي على العكس من ذلك فأمر عجب!؛ وهو ما تعقبته بأقوال وتعليلات الفقهاء على اختلاف مذاهبهم.
