Abstract

The contract of lease is one if the prime fundamental financial contracts. The key feature of this contract is its flexibility. Which has earned it great significance in the contemporary world. It has a profound impact on a couple of modern issues such as the contracts of manufacturing, franchising and time sharing. Today's presentation discusses some important maxims related to the contract of lease. In my opinion, these maxims play a vital role in the codification of the contract of lease. عقد الإجارة من العقود المالية الأساسية. ومن أجل خصائصه: المرونة، التي أكسبته أهمية قصوى في العالم المعاصر. ولهذا العقد أثر عميق في جملة من القضايا الحديثة، ويتمثل ذلك في عقود: الاستصناع = المقاولة، والامتياز، والتملك الزمني المشترك. ويتناول حوارنا اليوم البحث حول أهم الضوابط الفقهية المتصلة بعقد الإجارة. وفي وجهة نظري يمكن أن يكون لها دور بنّاء في تقنين هذا العقد.
