Abstract

Examining the determinants of “Labor Hours” from Sharia prospective was our main goal. The researcher has adopted and quoted a number of Quranic and Hadith verses to be implemented for analyzing and reaching comprehensive conclusions. The paper dealt with defining the lease contract, types of employee, and working time’s determinants. The most important finding of our research paper was the Fuqha consensus that labor contracts must determine “Time Span” in private employment contracts. The Fuqha also recommended that it is encourage able to determine “Time Span” and job description as long as the work may be estimated precisely. The paper concluded that labor hours such as early morning hours should be encouraged; however noon-times (Siesta time), prayer times, and pre Friday prayer hours must be fairly respected. The general rule is that international, regional, and arbitral tribunal must be considered. And finally the state intervention to determine working hours, weekends, annual and sick leave should be regulated according to the Sharia regulations. كان بحثنا بعنوان تحديد ساعات العمل من منظور شرعي قد اعتمد واستدل بعدد من الآيات القرآنية والأحاديث النبوية المتعلقة بهذا الموضوع، وشمل البحث المحاور التالية فبدأ بتعريف الإجارة لغة وشرعًا، وأنواع الأجير، وأوقات العمل وضوابط تحديد ساعات العمل وكانت من اهم نتائج البحث التأكيد على إجماع العلماء على وجوب تحديد مدة العمل في عقود العمالة الخاصة دون العمالة المشتركة، جواز اجتماع تحديد المدة مع العمل إذا كان العمل مما ينضبط تقديره، وأن المرجع في ذلك العرف ومعرفة أهل الخبرة، ويقترح البحث أوقاتًًا ينبغي مراعاتها في العمل ومنها: تحري أوقات الصباح الباكر، تفريغ العامل في أوقات القيلولة وهي ما قبل الظهيرة أو العصر ومراعاة الأوقات الدينية التي لا يسع وقته غيرها، إلا ما كان ضروريًا، وتجنب الأوقات الحرجة لدى بعض الأعمال الحساسة، وتحكيم الأعراف الإقليمية والزمانية في تحديد مدة العمل، وأخيرا جواز تدخل الدولة لتحديد ساعات العمل والإجازات الأسبوعية والسنوية والمرضية ونحوها وفق قواعد الشرع.
