Abstract

Das Verhältnis der beiden kollektivarbeitsrechtlichen Rechtskreise, der Betriebsverfassung und des Tarifvertrags, ist komplex, rechtspolitisch kontrovers und rechtswissenschaftlich ein Dauerbrenner. Die Prärogative der Tarifautonomie muss gewahrt werden, schon aus verfassungsrechtlichen Gründen - auch vor Versuchen, sie mittels betrieblicher Regelungen auszuhöhlen. Gerade nach Umstrukturierungen und Betriebsübergängen werden Betriebsvereinbarungen bisweilen für Versuche genutzt, Entgeltbestandteile abzusenken. In Fällen wiederum, in denen kein Tarifvertrag greift, können wenigstens Betriebsvereinbarungen Rechte der Belegschaft regeln. Prof. Dr. Daniel Klocke, Johannes Gutenberg-Universität Mainz, entwickelt im vorliegenden Band ein überzeugendes und praktisch handhabbares Konzept für das Zusammenspiel von Tarifverträgen und Betriebsvereinbarungen.
