Sozialrecht und Tarifbindung Regulierung von Arbeitsbedingungen durch Leistungserbringungsrecht?

Abstract

Das Ziel, Gesundheits-, Pflege- und Sozialberufe attraktiver zu machen, ist nicht nur im Koalitionsvertrag der neuen Bundesregierung vorgesehen. Es war auch in der Vergangenheit Gegenstand sozialrechtlicher Reformen. Dabei wurde auch bei der Verbreitung von Tariflöhnen und der Stärkung der Tarifbindung angesetzt. In diesem Zusammenhang stellen sich Rechtsfragen, die bisher wenig erforscht wurden: Wie beeinflussen sozialrechtliche Regelungen die Arbeits- und Entlohnungsbedingungen in den betreffenden Branchen, die Voraussetzungen für die Ausübung der Koalitionsfreiheit und die Funktionsfähigkeit der Tarifautonomie? Inwiefern kann das Sozialrecht die Tarifbindung in den Gesundheits-, Pflege- und Sozialberufen fördern? [...]
