Werk- und Dienstverträge: Praxiswissen Betriebsvereinbarungen

Abstract

Der Einsatz von Werk- und Dienstverträgen birgt verschiedene Herausforderungen für die Arbeitnehmerschaft und die Mitbestimmung. Betriebsvereinbarungen können dabei helfen, den Einsatz von Werk- und Dienstverträgen im Unternehmen zu steuern und zu regulieren, Beschäftigung auf Seiten des Einsatzunternehmens sowie in den Werk- und Dienstvertragsunternehmen abzusichern und Rechte des Betriebsrates zu konkretisieren. Im Rahmen der Auswertung wurden 42 Dokumente analysiert. Die untersuchten Regelungsinhalte betreffen Fremdleistungsplanung, Begrenzung der Fremdvergabe, Auswahlkriterien für Werk- und Dienstvertragsunternehmen sowie Angebote für Werk- und Dienstvertragsarbeitskräfte.
