Gewerkschaftsvertreter im Aufsichtsrat: Gutachten zur Verfassungsmäßigkeit des § 7 Mitbestimmungsgesetz

Abstract

Immer wieder äußern Kritiker der Mitbestimmung Zweifel an der Legitimation und der Verfassungsmäßigkeit externer Arbeitnehmervertreter, die die Gewerkschaften nach § 7 Mitbestimmungsgesetz zur Wahl in die Aufsichtsräte den Arbeitnehmern vorschlagen. Dabei hatte bereits die erste Biedenkopf-Kommission 1970 ein eigenes Nominationsrecht der Gewerkschaften vorgeschlagen und betont, dass dies seine Wirkungen nur entfalten kann, wenn es ausschließlich den Gewerkschaften zusteht.Jürgen Kühling, ehemaliger Richter am Bundesverfassungsgericht, überprüft anhand der einschlägigen Rechtssprechung, zu der vor allen Dingen und immer noch das Urteil des Bundesverfassungsgerichts zum Mitbestimmungsgesetz vom 1.3.1979 gehört, und der aktuellen Fachliteratur detailliert dieses eigene Teilhaberrecht der Gewerkschaften im Interesse der Arbeitnehmer. Er kommt zu dem Ergebnis, dass dieses Recht auch heute noch ohne jede Einschränkung mit der Verfassung in Einklang steht.
