Die arbeitgeberfinanzierte betriebliche Altersversorgung: Entwicklungen, Risiken und Probleme

Abstract

Zunehmend geringere Leistungen in der gesetzlichen Rentenversicherung führen zu einer steigenden Bedeutung der betrieblichen Altersversorgung. Im vorliegenden Beitrag sind aktuelle Entwicklungen sowie Risiken und Probleme der arbeitgeberfinanzierten betrieblichen Altersversorgung dargestellt. Nach einer knappen Einführung zu den Durchführungswegen der betrieblichen Altersversorgung ist der Trend zu beitragsorientierten Zusagen und zur Kapitaldeckung beschrieben. Die Funktionsweise der von vielen Unternehmen neuerdings genutzten Contractual Trust Arrangements (CTA) wird erläutert.Einen großen Teil nimmt die Auseinandersetzung mit ausgewählten für die Beschäftigten bestehenden Risiken ein, die sich z.B. bei Veränderungen der Altersversorgungszusage, bei einem Betriebsübergang oder im Falle einer Unternehmensinsolvenz ergeben.Größere Veränderungen gab es auch bei der Bilanzierung von Versorgungsverpflichtungen. Hier werden die Auswirkungen des Bilanzrechtsmodernisierungsgesetzes dargestellt sowie die Veränderungen nach IFRS, die ab 2013 für Unternehmen, die nach IFRS bilanzieren, zwingend anzuwenden sind.
