La Excepción de Incumplimiento Contractual: Estructura, Función y Límites

Abstract

La excepción de incumplimiento contractual es un remedio sinalagmático eficaz en la tutela de los intereses de los contratantes, en cuanto garantiza la interdependencia de las prestaciones y el equilibrio del vínculo negocial, colabora con el correcto funcionamiento del contrato y evita la destrucción del mismo. Es una tutela fundamentada en la buena fe, en virtud de la cual se reconoce a la parte fiel del contrato sinalagmático la facultad o la potestad de rehusarse legítimamente al cumplimiento de la prestación a la que está obligado, mientras que su contraparte no cumpla o no ofrezca contemporáneamente el cumplimiento de la contrasprestación.
