Abstract

Cuando se vaya a iniciar un proceso ante la justicia laboral se dede tener claridad respecto a quién o quiénes se ls interpondrá la demanda y en qué calidad se les convoca para quienes en el caso de una condena haya claridad en la forma como entrarán a responder cada uno de ellos de las obligaciones laborales pendientes de cumplirle al trabajador y que dieron origen a la demanda. En algunas ocasiones es complejo identificar quién debe ser realmente el responsable de las obligaciones generadas en una relación laboral. sobre todo cuando en la misma intervienen varias personas naturales o jurídicas con características de verdadero empleador que, incluso asumiendo ese carácter, están constituidas para ocultar quién debe tener calidad, por ello, tener claridad sobre quién o quiénes son susceptibles de ser demandados para obtener la satisfacción de la obligación adeudada y demás derechos laborales que correspondan al trabajador es un tema que amerita una revisión.
