Abstract

En este escrito, clásico de la literatura del derecho internacional, Hans Kelsen se cuestiona si la sentencia del juicio de Núremberg es realmente un precedente judicial. Entre otros aspectos, resulta discutible reconocer una verdadera fuente del derecho que permita deducir inequívocamente la posibilidad de castigar penalmente, esto es, de manera individual, la participación en un crimen contra la paz.
