El Principio de Precaución en una Sociedad de Riesgos Ambientales

Abstract

En todos estos ámbitos se fue formando todo un proceso de maduración acerca de una idea sustancial para el régimen jurídico-administrativo para la protección del ambiente: el principio de precaución es la garantía de eficacia para dicha protección. De dicha idea fueron surgiendo diversos interrogantes que debía delimitar inicialmente para lograr estructurar este trabajo: ¿qué es la precaución? ¿Cuál es su contenido? ¿Por qué se afirma que es un principio jurídico? ¿Cuáles son los elementos del principio de precaución? ¿Qué es y qué comprende el riesgo como primer elemento? ¿Qué es y qué comprende la incertidumbre? ¿Son asimilables prevención y precaución? ¿Qué fundamentos filosófico-jurídicos lo sustentan?; ¿cómo se incorpora al discurso jurídico? ¿Cuál es su contenido desde la perspectiva jurídico-administrativa? ¿Qué influencia tiene sobre las decisiones de la administración pública? ¿Qué excesos y límites deben imponerse para su adecuada aplicación por parte de la administración pública encargada de la protección del ambiente?; y, ¿cómo se puede establecer la responsabilidad patrimonial del Estado como consecuencia de las decisiones fundadas en el principio de precaución y orientadas a la protección del ambiente?
