Abstract

La fiducia mercantil y pública en Colombia constituye un esfuerzo de presentación de carácter histórico y conceptual del contrato de fiducia y resalta su génesis, desarrollo y aplicabilidad actual. El texto está enriquecido con reflexiones dogmáticas en cuanto a la incorporación de la figura en nuestro ordenamiento jurídico, así como en torno de la construcción dogmática del patrimonio autónomo y de si sobre este existe o no representación. Pero quizá la parte más sugestiva de esta contribución la constituye la explicación de la rica casuística que el contrato de fiducia nos ofrece en la hora actual y que el autor se esfuerza en relevar con el análisis de la jurisprudencia que la Corte Suprema de Justicia ha emitido sobre este contrato y de importantes laudos arbitrales en donde se ha destacado sobre manera el tema de la responsabilidad del fiduciario, sus específicas obligaciones y el contenido de la relación jurídica que se deriva de una modalidad contractual fundamentada en la confianza y en la buena fe de sus sujetos intervinientes.
