El debate Hart-Fuller

Abstract

Los dos ensayos aquí presentados, publicados originalmente en Harvard Law Review, son constitutivos de un célebre debate de teoría jurídica anglosajona sobre la relación entre Derecho y Moral, que se libró a finales de los años cincuenta entre los profesores Lon Fuller y Herbert Hart, y que sirvió de antesala a la discusión iusteórica que posteriormente tendría este último con Ronald Dworkin. Dicho debate nos muestra el trasfondo teórico que inspiró a Hart en su obracentral El Concepto de Derecho y expone la forma como el iusnaturalismo del siglo XX transforma y adapta lentamente su pretensiónde legitimar las normas jurídicas a través de contenidos externos al derecho. Por lo demás, se trata de un debate representativo del modo como la tradición jurídica anglosajona abordó, tras la caída del régimen nacionalsocialista, el problema de legitimación del derecho positivo en el Estado liberal Y democrático.
