Responsabilidad Constitucional: El Juez de Tutela en la reparación de daños

Abstract

En Colombia, para el derecho de la responsabilidad del estado o del particular, se ha diseñado desde la constitución y la ley un sistema de medios de control-ordinarios- que permiten la reparación de los daños. A partir de ellos, podría afirmarse, siempre existirá un instrumento-y un juez- que, con fundamento en una responsabilidad administrativa o civil y patrimonial, garantiza que toda tipología del perjucio se reconozca, asegurando la reparación integral.En este contexto, la acción de tutela resultaría abiertamente ajena, por cuanto la amenaza o vulneración a derechos fundamentales es un suceso excluido del derecho de daños, aunado a que su protección efectiva se alcanza mediante órdenes de actuar o de abstenerse de hacer.
