Salvajes, bárbaros e inmigrantes en el derecho administrativo hispanoamericano

Abstract

El Estado liberal colombiano, en su vertiente radical y regeneradora, se sustentó, entre otras ideas, sobre la necesidad de la inmigración. Esta tenía dos propósitos básicos que eran el mejoramiento racial, conocido en otras ciencias sociales como el blanqueamiento, y la importación de mano de obra para las tareas vergonzantes. El reverso de la moneda de este fenómeno era la salvajización y barbarización de nuestras poblaciones indígenas y afrocolombianas, las cuales debían ser civilizadas por los religiosos mediante las misiones religiosas. En este libro exponemos que tanto la inmigración como la civilización son materias del derecho administrativo colombiano que derivan del pensamiento absolutista de la ciencia de la policía y que nosotros incorporamos desde la Colonia. El trabajo, por ello, muestra unas continuidades que ponen en duda el exclusivo influjo francés sobre nuestro ordenamiento administrativo.
