Reelección indefinida vs. Democracia constitucional. Sobre los límites al poder de reforma constitucional en el Ecuador

Abstract

Este trabajo lleva a cabo un análisis crítico, con especial atención al caso del Ecuador, de la práctica abusiva intentada por varios presidentes en América Latina, y que consiste en reformar la Constitución para poder perpetuarse en el poder –a veces de forma indefinida–. El texto explica por qué dicha práctica es incompatible con varios de los pilares del constitucionalismo democrático: el principio del Estado de derecho, el derecho a la igualdad, el talante deliberativo de la democracia y el principio de alternancia en el ejercicio de las funciones públicas.
