Abstract

“En cuanto a la contraposición de derecho natural y positivismo jurídico, se trata de una contraposición verdaderamente ‘clásica’. Ningún manual de filosofía del derecho excluye este tema, no hay una sola discusión de filosofía del derecho en la que –ya sea como reproche o como sustento argumentativo– enunciados iuspositivistas o iusnaturalistas pudiesen carecer de importancia. … En lo que sigue no deseo resolver este conflicto en modo alguno; solamente se debe desarrollar en la medida de lo posible una comprensión precisa de qué posiciones son adecuadamente etiquetadas como iusnaturalistas o como iuspositivistas y cuáles no. Y aquí se hace manifiesta una gran cantidad de malentendidos y juicios equivocados, a saber, tanto en relación al positivismo jurídico como al derecho natural.” Horst Dreier
