Del derecho de gentes al derecho humanitario en Colombia, 1821-1995: debate sobre una idea constitucional

Abstract

El derecho de gentes, lejos de haber sido estudiado con fruición, ha sido desdeñado por la doctrina que no lo ha abordado a profundidad. Por esa razón este somero estudio de historia del derecho permitirá observar la importancia que en nuestro ordenamiento tuvo el derecho de gentes en el siglo XIX y la forma como se reconstruyó mediante el derecho humanitario en el siglo XX. En el estudio se aborda su institucionalidad, sin caer en el fanatismo al que se ha llegado por parte de algunos académicos colombianos de atribuirles a los extranjeros el origen de nuestras instituciones, sin ahondar en nuestro pasado constitucional.
