Abstract

El contrato de fiducia se ha posicionado como una figura contractual de uso frecuente en el devenir del comercio, entre otras cosas, por lo práctico que resulta a la hora de emprender y desarrollar los más variados proyectos de negocio. En esta edición se recoge la experiencia adquirida en estos últimos años en temas tan importantes y polémicos en la fiducia como el conflicto de intereses en el caso de grupos empresariales, y el alcance de la potestad decisoria del fiduciario frente a las instrucciones del fideicomitente; así mismo, el tema de los deberes de protección y la extensión del elenco de posibilidades que tienen las entidades estatales para utilizar la fiducia pública. El libro enriquece la doctrina que se ha forjado sobre diferentes temas de la fiducia, y cuenta con el análisis de las últimas sentencias de la Corte Suprema de Justicia relacionadas con este particular negocio, basado en la buena fe y la confianza. Este aggiornamento está dirigido a todos aquellos que estén interesados en abordar, desde un punto de vista práctico y reflexivo, los fundamentos de la fiducia mercantil y su paulatina asimilación en el sector estatal.
