La carga del perjudicado de evitar o mitigar el daño. Estudio histórico-comparado

  • Lilian C. San Martín Neira
Registered author(s):

    La proliferación de las demandas por responsabilidad civil y la cuantía cada vez más alta de las condenas al resarcimiento hacen necesario analizar los criterios de delimitación del daño resarcible. Ese es el propósito del presente trabajo que se ocupa específicamente del rol que corresponde a la víctima en la contención del daño y de su influencia en el quantum respondeatur. El trabajo utiliza el método histórico-comparado para sustentar que en el sistema romanista de derecho, específicamente en el subsistema latinoamericano, el perjudicado tiene la carga de evitar o mitigar el daño. Ello implica que el perjudicado no tendrá derecho a resarcimiento por aquellos daños que habría podido evitar o mitigar, por tanto, deberán ser excluidos de la cuantía del resarcimiento. El argumento aquí presentado ha ocupado a la doctrina civilista desde hace años; sin embargo, esta es la primera obra que abarca el argumento en profundidad, desde el Derecho romano hasta los más importantes proyectos de unificación del derecho privado, y constituye, además, la primera monografía sobre el argumento en lengua castellana.
