Violencia sexual en conflictos armados y derecho penal internacional

Abstract

Al fenómeno de la violencia sexual durante la guerra se le prestó escasa atención por mucho tiempo. Sin embargo, la vertiginosa evolución del derecho internacional humanitario y del derecho penal internacional desde los juicios de Nuremberg, en relación con la reciente ola de violencia sexual, sobre todo en el este de la República Democrática del Congo, ha situado el fenómeno en el centro de la atención mundial. En esta pequeña contribución se clarificará, tras una breve introducción sobre la relación general entre delitos sexuales y derecho penal internacional (i), la situación jurídica desde el punto de vista penal internacional (ii).
