El desarrollo sostenible y el derecho fundamental a gozar de un ambiente sano

  • Óscar Darío Amaya Navas
Registered author(s):

    El desarrollo sostenible se ha promocionado como un modelo económico compatible con la protección y la preservación de los recursos naturales, que supone un alto concepto de responsabilidad social, económica y ambiental a cargo del Estado y también de los particulares. El derecho a gozar de un ambiente sano, por su parte, se ha convertido en un derecho de gran importancia para garantizar la calidad de vida de las actuales y de las futuras generaciones. El lector encontrará en esta investigación académica las razones por las cuales el desarrollo sostenible es, precisamente, el determinador de la naturaleza fundamental del derecho a gozar de un ambiente sano, y está en condiciones, además, de constituirse en petición de principio general del Derecho. La naturaleza fundamental del derecho a gozar de un ambiente sano se predica, en consecuencia, de su ubicación normativa, de su desarrollo jurisprudencial y legal, y, especialmente, del aporte que el desarrollo sostenible le da en estos tiempos modernos, como núcleo o contenido esencial, mínimo e irreductible de este derecho.
