La regulación de la minería en la Unión Europea y su compatibilidad con la normativa medioambiental comunitaria: el caso de España

Abstract

En la presente obra se aborda el estudio de la regulación comunitaria del sector minero a la luz de su evolución desde el Tratado Constitutivo de la Comunidad Europea del Carbón y del Acero (CECA) hasta el reciente Tratado de Funcionamiento de la Unión Europea (TFUE). Este análisis no sólo parte de la política y la normatividad comunitaria, sino que también se detiene en el impacto de esta evolución en el contexto español. Paralelamente, y acorde con las implicaciones de la industria, este estudio se ocupa de la protección ambiental en la industria minera europea, en particular, tratándose de la regulación comunitaria de la responsabilidad por daños al medio ambiente.
