¿Por qué la Constitución importa?

Abstract

Tal vez piense que la Constitución importa porque protege nuestros derechos fundamentales. La respuesta que doy aquí es diferente: la Constitución importa porque da estructura a nuestro proceso político. Y es que la fuente última –y a veces la inmediata– de cualquier protección que tengamos de nuestros derechos fundamentales no es la Constitución sino la política. Esta es una breve presentación de las razones por las cuales su primera respuesta, relacionada con los derechos fundamentales, no es del todo correcta. La gente no coincide en cuáles son nuestros derechos fundamentales, y nadie cree realmente que todo lo que la Corte Suprema dice sobre esos derechos es la última palabra
