Abstract

Esta obra ofrece una percepción novedosa de la regla de exclusión de la prueba ilícitamente obtenida, a partir de un estudio profundo en torno al objetivo constitucional de preservar el derecho fundamental a la intimidad. Se propone un método adecuado para delimitar el ámbito de protección, y a partir del análisis detallado de los canales de acceso al material probatorio por medio de incursiones en la intimidad, se separa el material probatorio de la actividad invasiva realizada para conseguirlo y del empleo que pueda tener.
