La prueba de oficio. Una perspectiva para el proceso dialógico civil

Abstract

La prueba de oficio es una investigación doctoral que expone de una manera clara y fundamentada la estructura jurídica y política que sustenta los poderes de instrucción en el proceso. Este análisis se establece desde el estudio del derecho procesal y acerca al lector a una perspectiva contemporánea; desde allí deja sentada la importancia de que en Colombia evolucionen los sistemas procesales, y se llega a dos conclusiones: la primera, que la perspectiva correcta de la prueba de oficio se lee y se interpreta a partir de la norma constitucional y la segunda, que desde los cánones del Estado social de derecho se inician las bases de lo que la autora llama “el proceso dialógico”.
