Vivir en policía: una contralectura de los orígenes del derecho administrativo colombiano

Abstract

El objetivo de este trabajo es el de ayudar a encontrar una identidad jurídica que Colombia ha perdido. Tomando como base la ciencia de la policía se debe entender que el derecho administrativo es un derecho mucho más antiguo de lo que la mayoría de nuestros autores plantean. Y ello por la sencilla razón de que el encauzamiento del poder entre nosotros lleva más de cuatrocientos años, y no casi cien como lo expresan los doctrinantes colombianos formados en la tradición francesa. Escuela ésta que nos ha impuesto la famosa frase de Luis xiv, de “El Estado soy yo”, para indicarnos que únicamente con la Revolución Francesa y con la invención del principio de legalidad es que la administración se somete al derecho.
