Corrección monetaria de obligaciones dinerarias

Abstract

La mayoría de los sistemas jurídicos se proyectan sobre la base del principio nominalista que establece la fijeza en el monto de las obligaciones dinerarias; el valor nominal de la prestación permanecerá constante a lo largo de la vida de la obligación. En efecto, ¿qué sentido tendría adoptar la indeterminación en el valor de obligaciones pecuniarias en tiempos de estabilidad monetaria? Ciertamente, ninguno. Pero la situación es otra cuando la economía se enfrenta a una escalada en el nivel de precios. Cuando el fenómeno inflacionario llega a interferir en las relaciones jurídicas, es necesario dejar de lado la inmutabilidad en el valor nominal de las obligaciones para abrirle paso a la posibilidad de aplicar mecanismos de actualización; cuando la realidad cambia, los mecanismos para enfrentarla deben cambiar también.
