Apropiación indebida de recursos genéticos, biodiversidad y conocimientos tradicionales: “biopiratería”

Abstract

Este trabajo tiene el propósito de exponer sistemáticamente todo lo relacionado con la biopiratería, ofrecer diversos conceptos y acercar una definición, mostrar cómo funciona, cuáles son sus elementos, sus etapas, sus modalidades, identificar el papel que juegan en su proceso los distintos intervinientes, la legislación internacional, regional y local en materia de comercio, propiedad intelectual, diversidad natural y los conocimientos tradicionales de comunidades locales e indígenas asociados a ella; los roles que juegan los países industrializados frente a los países en vías de desarrollo y la importancia de la biotecnología y los organismos transgénicos en el proceso de la biopiratería. Con el desarrollo del análisis anterior, se busca esclarecer otro problema jurídico: ¿es suficiente la normatividad actual para evitar o contrarrestar la denominada biopiratería?
