Abstract

Este trabajo aborda la estrecha relación entre el derecho penal, la filosofía del derecho, y la filosofía política, más allá de la visión clásica de la teoría de la pena y la finalidad del derecho penal, para tal se realiza una aproximación a las concepciones de Hobbes y Feuerbach, encontrando en ellos los fundamentos iusfilosóficos del delito omisivo, y se examina la concepción de persona dentro del espíritu objetivo de la filosofía hegeliana, planteando una serie de consecuencias para el derecho penal.
