Abstract

En cualquier forma de control social se busca siempre hacer responder a una persona por su comportamiento desviado frente a las expectativas del grupo, lo cual supone una teoría de la responsabilidad en la que se responsabiliza al hombre sólo en la medida de sus decisiones. Sancinetti explora en esta obra en la teoría del ilícito fundada en la capacidad motivadora del derecho, en el principio de culpabilidad y en el concepto de ilícito que puede incluir decisiones de acción.
