Subjetivismo e imputación objetiva en derecho penal

Abstract

Síntesis de la teoría del ilícito, ceñida al disvalor de acción y cerrada al disvalor de resultado, del profesor Sancinetti donde se exponen sus fundamentos y sus consecuencias dogmáticas y se demuestra que no es incompatible con el desarrollo de la actual teoría de la imputación objetiva, ya que la propia obra de Jakobs ofrece un riquísimo material en apoyo de una teoría subjetiva del ilícito penal y en contra del carácter constitutivo del disvalor de resultado.
