Sociedad, norma, persona en una teoría de un Derecho penal funcional

Abstract

Desde la perspectiva de la que aquí se parte, el funcionalismo jurídico-penal se concibe como aquella teoría según la cual el Derecho penal está orientado a garantizar la identidad normativa, a garantizar la constitución de la sociedad. Partiendo de esta concepción, no se entiende la sociedad, a diferencia de lo que creyó la filosofía, adoptando el punto de vista de la conciencia individual, como un sistema que puede componerse de sujetos que concluyen contratos, producen imperativos categóricos o se expanden de modo similar.
