El delito de defraudación de fluidos

Abstract

A raíz de la entrada en vigencia del Código Penal de 2000, el delito de “defraudación de fluidos” hizo su aparición en la legislación nacional, tomando como referencia la descripción típica contenida desde hace ya varias décadas en la legislación penal española. Esta figura desde un comienzo invitó a un análisis particular en la medida que la situación de los servicios públicos en Colombia, de tiempo atrás, viene presentando gran cantidad de casos de fraude, situación que afecta la estabilidad de los prestadores de servicios quienes, de otra parte, son criticados por su falta de cobertura, errores en las mediciones y tarifas, así como arbitrariedad al momento de la investigación de situaciones anómalas.
