La posición de la justificación y de la exculpación en la teoría del delito desde la perspectiva alemana

Abstract

Hirsch asume en esta obra las expresiones “justificación” y “exculpación”, como todas aquellas causas que deben excluir el injusto o la culpabilidad relevante y estudia la necesidad de diferenciar dentro de los presupuestos del delito entre la cuestión de la justificación y la de la exculpación, lo cual equivale a decidir a favor de la necesidad de un sistema dogmático que tome como punto de referencia esencial la existencia de escalones valorativos, pues se trata de diferenciar entre injusto y culpabilidad, es decir, de distintos planos de valoración.
