Abstract

Los ensayos que componen este libro contienen las piezas másimportantes de la obra de Aharon Barak. En ellos, el autor aborda los temas másdifíciles atinentes a la aplicación de los derechos fundamentales por parte deljuez constitucional, la función de los jueces en una democracia, la naturaleza dela discreción judicial, la posibilidad de enmiendas constitucionalesinconstitucionales, y expone su propia doctrina de la proporcionalidad y suoriginal concepción dogmática de la dignidad humana.
