Abstract

Comoquiera que no existe en nuestro ordenamiento una reglamentación especial que regule las relaciones de familia, no obstante ser ésta una institución que requiere de un tratamiento especial y preferente respecto de las situaciones de orden civil o comercial, teniéndose que acudir a las normas consagradas en el Código Civil y de Procedimiento Civil para buscar solución a los conflictos de familia; por ello es importante hacer una recopilación de los diferentes trámites consagrados en el Código de Procedimiento Civil que deben ser aplicados en la solución de estos conflictos, con el objeto de mirar si este es el procedimiento adecuado o si, por el contrario, se requiere adoptar un procedimiento único que permita buscar la solución a los conflictos de familia de una manera más ágil y menos traumática que la existente en el área en la que actualmente se encuentra, todo con el fin de resaltar la importancia que el Estado y la sociedad deben reconocer a la institución familiar.
