Concepto y control del procedimiento legislativo

Abstract

El trabajo que en estas páginas se contiene es un análisis del ordenamiento jurídico colombiano, así como de la interpretación que del mismo ha sido plasmada en la jurisprudencia de la Corte Constitucional, en lo relacionado con el tema de la invalidez de la ley por vicios formales. Este tipo de irregularidades y sus consecuencias, no obstante su gran importancia, han sido un tema que no ha despertado especial interés en la doctrina colombiana, lo que se aprecia fácilmente cuando comprobamos las tangenciales referencias que al mismo se hacen en los libros que tratan sobre la actividad legislativa, así como la inexistencia hasta hace muy poco de una publicación que lo hubiese escogido como punto central de su análisis1. Esta situación se mantiene incluso después de haber entrado en vigencia el nuevo régimen constitucional, en el que se creó un sistema totalmente novedoso control de los vicios acaecidos durante el trámite de elaboración legislativa, lo que pareciera indicarnos que la apatía de la doctrina colombiana por profundizar en este tema tiene caracteres congénitos.
