Abstract

Me complace presentar la segunda entrega de la colección "Lecturas sobre Derecho de Tierras" en la cual se refleja el trabajo que vienen adelantando diferentes investigadores de nuestro Grupo, así como algunos profesores de la Especialización en Derecho de Tierras, además de varios invitados especiales, en proyectos de investigación relacionados con la "Reforma agraria" y la "Restitución de tierras", cuyo resultado el lector tiene ahora en sus manos. En esta oportunidad el libro se ha distribuido en cuatro partes: la propiedad en Colombia; reparación de víctimas y restitución de tierras; reforma rural integral y ordenamiento productivo de la propiedad, y derecho de tierras y medio ambiente. El primer capítulo se inicia con el artículo de Ramón Antonio Peláez Hernández, quien nos presenta el tratamiento de la propiedad privada desde la perspectiva del Estado social de derecho, para lo cual explica la forma en que a partir de la Constitución y del Pacto de San José se han construido mecanismos de protección de la propiedad. Este primer texto constituye la base teórica que permite ahondar posterior mente en otros asuntos relacionados con el ejercicio y la protección de ese derecho fundamental.
