Abstract

Im November 2003 setzte der Rat der EU Finanzminister im Rahmen des Stabilitäts- und Wachstumspaktes die Defizitverfahren gegen Deutschland und Frankreich aus. Gegen diese Entscheidung klagte die EU Kommission vor dem Europäischen Gerichtshof. Welche Vorgehensweise ist im Stabilitäts- und Wachstumspakt formalrechtlich vorgesehen und welchen Verlauf nahmen die Defizitverfahren tatsächlich? Sind im Pakt Konstruktionsmängel festzustellen?
