Die „gerechte“ Strafe im Kartellverfahren

Abstract

Im Zuge der 7. Novelle des Gesetzes gegen Wettbewerbsbeschränkungen (GWB) wurden die Sanktionsmöglichkeiten der Kartellbehörden bei nachgewiesenen Verstößen gegen das Kartellverbot drastisch erhöht. Damit soll in erster Linie einer verminderten Kontrolldichte Rechnung getragen werden. Die Höhe der Geldbuße kann nunmehr bis zu 10 Prozent des Gesamtumsatzes des vergangenen Geschäftsjahres betragen. Jedoch bedeutet dies für einige Unternehmen das wirtschaftliche Aus, da mit der Geldbuße ihr gesamtes Eigenkapital abgeschöpft würde. Dies ist aber wettbewerbspolitisch nicht erwünscht. Aber ein Kartellvergehen ist auch kein Kavaliersdelikt und muß entsprechend bestraft werden. Schließlich würden sonst falsche Anreize gesetzt werden, und Unternehmen würden vermehrt illegale Kartelle bilden. Die Behörden stehen somit vor dem Dilemma eine gerechte Strafe zu finden.
