Abstract

Die Frage, ob ein verpflichtendes letztes Kindergarten-Jahr verfassungsrechtlich zulässig ist, wurde bislang in der Literatur kontrovers diskutiert. Der vorliegende Beitrag, der auf einem Rechtsgutachten für das Staatsministerium für Kultus beruht, beleuchtet die Rechtslage erstmals umfassend mit Blick auf den Freistaat Sachsen, der eine solche Pflicht in dieser Legislaturperiode einführen will. Da sich die Maßstäbe der verfassungsrechtlichen Prüfung hauptsächlich aus dem Grundgesetz ergeben, lassen sich die Ergebnisse der Untersuchung weitgehend auch auf andere Bundesländer übertragen.
