Abstract

Was erklärt die Zunahme offen strategisch geführter Verfahren in Deutschland? Ein Blick auf die Entwicklung des Verfahrensrechts liefert eine erstaunliche Erklärung: Der Ausbau von kollektivem Rechtsschutz und Reformen des Beratungsrechts haben einen günstigen Rahmen für die strategische Nutzung von Recht durch Klagekollektive geschaffen. Angesichts des zugangsfördernden Potenzials strategischer Prozessführung ist dies positiv zu bewerten.
