Risks Excluded In The Life Insurance Contract In The Event Of Death – Legal Aspects

Abstract

The subject of the current article is the legal regulation of excluded risks with the life insurance contract in the event of death. There are discussed successively the peculiarities of excluded risks with this type of insurance in view of the effective insurance legislation. For the purposes of the exposition there is paid particular attention to the notion of „suicide” in the context of the life insurance contract in th e event of death. There is clarified the connotation of the types of suicide – realized and unrealized. There is discussed death, caused by the beneficiary as a special case of coverage exclusion with respect to a particular subject, which ensues from the legal system of the life insurance contract in favour of a third party. In this connection there is an emphasis on the issue of the grounds, on which the beneficiary loses his rights under the contract and the insurance amount is paid to the heirs. For that purpose there is made a parallel with the grounds for annulment of the donation agreement and the grounds for unworthiness as close legal figures. There are also discussed the peculiarities of the rest of the excluded risks with the life insurance contra ct, namely: death ensuing from the commitment of a criminal offence of general character on the part of the insured or from the execution of a death sentence, as well as death occurring during war, military operations or an act of terrorism.
