Processing Of Personal Data Of Children In The Context Of The Labor Relations

Abstract

The General Data Protection Regulation (Regulation (EU( 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC( repeatedly touches on the topic of protection of personal data of minors, who represent a more vulnerable group of data subjects in need of enhanced protection. The most important text of the Regulation in this regard is the provision of Art. 8 introducing conditions applicable to the consent of a child in relation to information society services. The purpose of this analysis is to trace what the Regulation introduced in relation to the processing of personal data of children, as well as to look for the specifics on the field of labor law - when, under what conditions and in what way the employer should process personal data of minors.
